Introduction

These Terms of Service ("Terms") govern your use of the Speechy mobile application ("App") operated by 吉华 郑 ("we", "us", or "our"). Please read these Terms carefully before using our App. By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.

Use of the App

Speechy is a voice-to-text application that allows users to transcribe speech into text, record audio, and share content. By using our App, you agree to use it only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the App.

You are responsible for ensuring that any content you create, upload, or share through the App complies with applicable laws and regulations.

User Accounts

Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Subscriptions and Payments

Speechy offers both free and premium subscription options. By subscribing to our premium services, you agree to pay the applicable fees as they become due. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

You can manage your subscription and auto-renewal by going to your Account Settings in the App Store after purchase. No refund will be provided for the unused portion of a subscription period if you cancel during an active subscription period.

Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Speechy and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Speechy.

User Content

You retain all rights to any content you submit, post, or display on or through the App. By submitting, posting, or displaying content on or through the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your content in any and all media or distribution methods.

You are solely responsible for your content and the consequences of posting or publishing it. We do not endorse any content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with user content.

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. Speechy and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither Speechy nor its suppliers and licensors makes any warranty that the App will be error-free or that access thereto will be continuous or uninterrupted.

Limitation of Liability

In no event will Speechy, or its suppliers or licensors, be liable with respect to any subject matter of these Terms under any contract, negligence, strict liability, or other legal or equitable theory for: (i) any special, incidental, or consequential damages; (ii) the cost of procurement of substitute products or services; or (iii) for interruption of use or loss or corruption of data.

Indemnification

You agree to indemnify and hold harmless Speechy, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the App, including but not limited to your violation of these Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
